SUBJECT: DELEGATION OF AUTHORITY FOR USE OF NON-FEDERAL HIRING INCENTIVES

1. THE NATIONAL DEFENSE AUTHORIZATION ACT FOR FISCAL YEAR 1995 AUTHORIZED THE SECRETARY OF DEFENSE TO ESTABLISH A NON-FEDERAL EMPLOYMENT INCENTIVE PILOT PROGRAM. THIS PROGRAM AUTHORIZED NON-FEDERAL EMPLOYERS TO HIRE AND RETRAIN DOD EMPLOYEES WITHIN 180 DAYS OF BEING INVOLUNTARILY SEPARATED BY REDUCTION IN FORCE DUE TO CLOSURE OR REALIGNMENT OF THEIR INSTALLATION. THE OSD GUIDANCE ON USE OF THE INCENTIVES AND ENCOURAGED REDELEGATION TO THE LOWEST PRACTICAL LEVEL.

2. AUTHORITY TO OFFER AND APPROVE PAYMENT OF THE NON-FEDERAL HIRING INCENTIVES IS HEREBY DELEGATED TO MAJOR ARMY COMMANDERS/HEADS OF INDEPENDENT REPORTING ACTIVITIES WITH FURTHER AUTHORITY TO REDELEGATE APPROVAL TO INSTALLATION COMMANDERS/HEADS OF ACTIVITIES OR THEIR DESIGNEES. APPROVING OFFICIALS ARE REMINDED THAT THE LAW LIMITS OFFERS OF THE INCENTIVES TO SITUATIONS WHERE THE EMPLOYEE HAS BEEN GIVEN A NOTICE OF SEPARATION PURSUANT TO A REDUCTION IN FORCE. PAYMENT OF THE INCENTIVES IS NOT AUTHORIZED FOR EMPLOYEES WHO REQUESTED SEPARATION WITH VOLUNTARY SEPARATION FUNCTION. THE POINT OF CONTACT AT THIS HEADQUARTERS IS
