H. ON FEBRUARY 16, 1996, THE OFFICE, SECRETARY OF DEFENSE (OSD) CONVENED A MEETING OF THE COMPONENTS REGARDING SUBJECT AND PROVIDED COPIES OF REFERENCES A TO G TO US. WE ARE PROVIDING FACSIMILE COPIES OF THE REFERENCES TO MACOMS AND INDEPENDENT REPORTING ACTIVITIES AND ASK THAT THEY PROVIDE COPIES TO THEIR OPERATING CIVILIAN PERSONNEL OFFICES (CPO).

2. THIS MESSAGE:

A. SUMMARIZES INFORMATION, PREVIOUSLY PROVIDED IN CIVILIAN PERSONNEL BULLETIN ITEMS;

B. SUMMARIZES ESSENTIAL INFORMATION DISCUSSED IN THE FEBRUARY 16, 1996, MEETING; AND

C. PROVIDES OPERATING GUIDANCE FOR THE REMAINDER OF FY 1996.

3. THE TREASURY, POSTAL SERVICE, AND GENERAL GOVERNMENT APPROPRIATIONS ACT FOR FY 1996, EFFECTIVE NOVEMBER 19, 1995, CONTAINED FOUR LEGISLATIVE CHANGES THAT SIGNIFICANTLY AFFECTED OPM'S EMPLOYMENT SERVICES AND FEDERAL AGENCIES' PERSONNEL MANAGEMENT OPERATIONS AND RESOURCES. THE STATUTORY CHANGES;

A. PERMIT OPM TO DELEGATE ALL COMPETITIVE EXAMINING TO AGENCIES, EXCEPT FOR ADMINISTRATIVE LAW JUDGES (ALJS);

B. REQUIRE ALL AGENCIES TO SHARE WITH OPM THE COST OF FEDERAL EMPLOYMENT INFORMATION SERVICES; AND

C. REQUIRE AGENCIES THAT CHOOSE NOT TO OBTAIN DELEGATED EXAMINING AUTHORITY TO REIMBURSE OPM FOR EXAMINING SERVICES PROVIDED ON AND AFTER JANUARY 1, 1996.

4. THE LEGISLATIVE CHANGES WERE NOT ANTICIPATED BY OPM OR THE AGENCIES AND PROVIDED LITTLE TIME FOR IMPLEMENTATION PLANNING.

5. REFERENCE C IS SIMILAR TO AGREEMENTS OPM IS ENTERING INTO WITH OTHER AGENCIES. IT AUTHORIZES DOD TO EXAMINE FOR ALL POSITIONS EXCEPT ALJS OR TO CONTRACT WITH OPM TO CARRY OUT SOME OR ALL OF ITS EXAMINING ACTIVITIES. OSD WILL BE ISSUING OPERATIONAL GUIDANCE BUT MUST FIRST ADDRESS A NUMBER OF ISSUES (SEE REFERENCE E). OSD IS FORMING A WORKING GROUP TO LOOK AT THOSE ISSUES AND WE WILL HAVE A REPRESENTATIVE ON THE WORKING GROUP.

6. BASED ON THE FEBRUARY 16, 1995, MEETING WITH OSD, OUR UNDERSTANDING OF THE SITUATION IS THAT:

A. OSD ATTEMPTED TO INCLUDE THE NEW EXAMINING EMPLOYMENT INFORMATION COSTS IN FY 96/97 BUDGET SUBMISSIONS, BUT SUBMISSION TIME FRAMES DID NOT ALLOW THIS, EVEN AS AN UNFUNDED REQUIREMENT. THESE COSTS WILL BE WORKED INTO THE POM IN APRIL 1996 FOR FY 98 AND OUT. MEANWHILE, THE COMPONENTS MUST ABSORB THE COSTS, BOTH FOR EXAMING AND EMPLOYMENT INFORMATION, FOR FY 96/97.

B. OPM IS REQUIRING CERTIFICATE REQUESTERS TO COMPLETE AN OPM FORM 1616 FOR REIMBURSABLE SERVICES. THE FORM CAN BE SUBMITTED TO THE OPM SERVICING CENTER ON A CASE BASIS OR TO COVER MULTIPLE REQUESTS. THE FORM MAY BE OBTAINED FROM OPM SERVICING CENTERS AND MUST BE SUBMITTED FOR ANY EXAMINING SERVICES REQUESTED ON OR AFTER JANUARY 1, 1996.

C. EXISTING DELEGATED EXAMINING UNITS (DEUS) MAY CONTINUE TO OPERATE FOR NOW, USING OPM'S OPERATING MANUAL OR OTHER OPM APPROVED PROCEDURES.

D. IF, IN THE PAST, AN ACTIVITY HAD A "MINI-DELEGATION" OF EXAMINING AUTHORITY, IT IS NO LONGER VALID. THESE DELEGATIONS EXISTED PREDOMINATLY IN OPM'S SAN ANTONIO REGION. OSD IS ASKING OPM TO DEFINE A "MINI-DELEGATION," BUT YOU SHOULD KNOW WHAT IT IS IF YOU HAD ONE.

E. OSD PLANS TO ISSUE GUIDANCE FOR FY 97 AND OUT. REALISTICALLY, "BUSINESS A USUAL" IS ALL THAT IS FEASIBLE FOR FY 96 (E.G., CPOS THAT HAVE DEUS SHOULD CONTINUE TO OPERATE THEM; CPOS THAT HAVE RELIED ON OPM IN THE PAST MUST CONTINUE TO DO SO). THERE IS SIMPLY INSUFFICIENT TIME TO ESTABILISH, TRAIN, AND CERTIFY MULTIPLE NEW DEUS FOR FY 96 OPERATIONS.
