SUBJECT: IMPACT OF NEW DOD POLICY ON MERIT PROMOTION ACTIONS

1. RECENT CLARIFICATION FROM OSD INCIDENT TO IMPLEMENTATION OF DODI 1404.12 {ENCL TO REF A} INDICATES THAT IT IS DOD POLICY TO REQUIRE INCLUSION OF MILITARY SPOUSE PREFERENCE ELIGIBLES IN THE MINIMUM AREA OF CONSIDERATION WHENEVER COMPETITIVE PROCEDURES ARE USED TO FILL A POSITION, REGARDLESS OF THE SOURCE {E.G., REINSTATEMENT, TRANSFER, E.O. ELIGIBLE, ETC.} FROM WHICH THE SPOUSE PREFERENCE ELIGIBLE IS APPLYING. THIS INTERPRETATION TAKES PRECEDENCE OVER POLICY CURRENTLY SET FORTH IN REFS C AND D ABOVE AND ANY OTHER GUIDANCE PREVIOUSLY ISSUED BY THIS HEADQUARTERS.

2. THE NEW POLICY INTERPRETATION WILL PRIMARILY IMPACT ON THE FILLING OF ALL NAF POSITIONS {BOTH OVERSEAS AND IN THE UNITED STATES} AND AF POSITIONS IN THE OVERSEAS AREA. APPLICATION OF SPOUSE PREFERENCE FOR AF POSITIONS IN THE UNITED STATES IS NOW AFFORDED THROUGH THE DOD PRIORITY PLACEMENT PROGRAM {REF B} EXCEPT FOR LIMITED EXCEPTIONS, E.G., EXCEPTED SERVICE POSITIONS. CPOS SHOULD TAKE IMMEDIATE STEPS TO MODIFY LOCAL MERIT PROMOTION PLANS TO REFLECT THAT WHENEVER COMPETITIVE PROCEDURES ARE USED TO FILL A VACANT POSITION, THE ACCEPTANCE, RATING, AND RANKING OF APPLICATIONS FROM ALL IMMEDIATELY APPOINTABLE SPOUSE PREFERENCE ELIGIBLES WISHING TO EXERCISE PREFERENCE ARE REQUIRED. PROVISIONS FOR THE ACCEPTANCE OF APPLICATIONS FROM DA STATUS CANDIDATES OUTSIDE THE MINIMUM AREA OF CONSIDERATION AS SET FORTH IN REF C REMAIN UNCHANGED AS DOES THE AUTHORITY TO EFFECT NONCOMPETITIVE MOVEMENTS OF CURRENT ARMY EMPLOYEES AS EXCEPTIONS TO MERIT PROMOTION PROCEDURES. THE FOREGOING INFORMATION WILL BE REFLECTED IN THE NEXT REVISION TO THE ARS.

3. WE ARE STILL AWAITING A RESPONSE FROM OSD REGARDING SEVERAL OTHER PLACEMENT AND SELECTION ISSUES RELATING TO IMPLEMENTATION OF DODI 1404.12. ADDITIONAL GUIDANCE WILL BE FORTHCOMING UPON RECEIPT OF THE OSD RESPONSE.
