SUBJECT: CHANGE TO IMPLEMENTING REGULATIONS FOR EXECUTIVE ORDER 12721 FOR HIRING FAMILY MEMBER OVERSEAS EMPLOYEES

A. 5 CODE OF FEDERAL REGULATIONS (CFR), PART 315.608, NONCOMPETITIVE APPOINTMENT OF CERTAIN FORMER OVERSEAS EMPLOYEES.

1. IN RESPONSE TO OUR REQUEST FOR SUPPORT FOR THOSE FAMILY MEMBERS WHO WERE INVOLUNTARILY RELOCATED TO THE U.S. DUE TO OVERSEAS DRAWDOWNS. THE OFFICE OF PERSONNEL MANAGEMENT (OPM) HAS REVISED REFERENCE A. THE FINAL REVISION WAS PUBLISHED IN THE FEDERAL REGISTER ON MARCH 8, 1996 (VOL. 6, NO. 47 PAGES 9321-9323). IT BECOMES EFFECTIVE APRIL 8, 1996. CPO STAFFS CAN ACCESS THIS DOCUMENT THROUGH THE PSM BULLETIN BOARD UNDER THE CATEGORY "CPM" AND FILE NAME "BR315DV5.TX."

2. SIGNIFICANT CHANGES INCLUDE ANY AGENCY CAN NOW DETERMINE/APPROVE IF AN INDIVIDUALS 5-YEAR PERIOD OF APPOINTMENT WAIVERS OF UP TO 26 WEEKS OF THE REQUIRED SERVICE TO INCLUDE NONPERSONAL, MANAGEMENT-INITIATED ACTIONS, SUCH AS DRAWDOWNS: CLARIFICATION THAT INDIVIDUALS SHOULD BE GIVEN CREDIT FOR PRIOR SERVICE IF THEY HAVE ALREADY SATISIFIED THE REQUIREMENT FOR TENURE: AND A NEW 2-YEAR OPEN PERIOD UNTIL MARCH 31, 1988, SO THAT INDIVIDUALS WHO RETURNED PRIOR TO THE ISSUANCE OF THESE REGULATIONS CAN BENEFIT FROM THE REVISIONS. WE ALSO HAD OPM INCLUDE CERTAIN PROVISIONS THAT HAD BEEN IN THE CORNER FEDERAL PERSONNEL MANUAL. SPECIFICALLY THAT CIVILIANS SERVICE NEED NOT BE CONTINUOUS, THAT AN ELIGIBLE NEED NOT BE A FAMILY MEMBER AT THE END OF NONCOMPETITIVE APPOINTMENT IN THE U.S. AND THE ELIGIBLES MAY BE APPOINTED IN AN OCCUPATION AND GRADE LEVEL FOR WHICH THEY QUALIFY.

3. WIDEST DISTRIBUTION OF THIS INCREDITION THROUGHOUT CPO STATUS IS IMPERATIVE SO THAT CORRECT GUIDANCE IS RELAYED TO FAMILY MEMBERS. CPOS SHOULD ALSO MAKE LATEST CHANGES THROUGHOUT THEIR LOCAL SERVICED AREAS SO THAT FAMILY MEMBERS ARE COVERED. BT
