SUBJECT: Appointment of Retired Members of the Armed Forces to Positions in the
 Department of the Army



Reference memorandum from the Acting Deputy Assistant Secretary of Defense, September 24, 2001, subject: Appointment of Retired Members of the Armed Forces to Positions in the Department of Defense (enclosure).

For the duration of the national emergency, Department of the Army appointing authorities may appoint retired members of the armed forces without processing a 180-day waiver. This policy applies to all appropriated and nonappropriated fund Army positions, including Senior Executive Service (SES) and equivalent positions. It should be noted that while the 180-day waiver is not required during the period of the declared national emergency, laws and regulations pertaining to merit system principles and prohibited personal practices still apply in the recruitment, selection, and appointment of retired military personnel. When the emergency ends, the waiver provisions of Deputy Assistant Secretary of the Army (Civilian Personnel Policy) memorandum, September 14, 2000, subject: Delegation of Authority to Approve Appointments of Retired Members of the Armed Forces Within 180 Days After Retirement, will again be effective.
