MEMORANDUM FOR SEE DISTRIBUTION
SUBJECT: Personnel Issues Related to Attacks on the World Trade Center and
 The Pentagon - Appointment Authority and Policy Waivers



The Office of Personnel Management has provided temporary excepted appointment authority for up to one year to reemploy former Federal employees or to hire new employees in support of rescue, recovery, investigation, military support and directly related functions. Appointments under this authority are exempt from priority placement and other displaced employee programs. Also, in response to a Defense Department request, the Office of Personnel Management has waived separation incentive pay repayment for former Federal employees who are rehired in the Defense Department under the new appointment authority, unless the buyout program under which they left the government did not provide for waiver of repayment.

The Office of Personnel Management has likewise delegated authority to waive dual compensation reductions on a case-by-case basis for Federal retirees when needed to fill temporary positions established to respond to the attacks of September 11, 2001. By the September 17, 2001, memorandum at Enclosure 1, the Under Secretary of Defense delegated this waiver authority within the Department of Defense. I hereby delegate this waiver authority to major Army commanders and to the Administrative Assistant to the Secretary of the Army who may further delegate the authority in writing to commanders and activity heads at the installation level but no lower. You are responsible for maintaining the records required by the Office of Personnel Management on each waiver of dual compensation reductions that is approved.

You must apply the new appointment authority and waivers in accordance with Enclosure 1 and the accompanying Office of Personnel Management memoranda. You are to submit the required report on waivers of repayment of voluntary separation incentive payments to reach my office, ATTN: SAMR-CPP-SM by end October 2002.
