MEMORANDUM FOR SEE DISTRIBUTION
SUBJECT: Delegation of Direct Hire Authority for Scientific and Engineering Positions within Personnel Demonstration Laboratories

  1. Reference Secretary of the Army memorandum, dated May 22, 2009, subject: Delegation of Direct Hire Authority for Scientific and Engineering Positions Within Personnel Demonstration Laboratories (Enclosure 1).
  2. I hereby delegate to the Commanders of the U.S. Army Materiel Command, the U.S. Army Medical Command, and the U.S. Army Corps of Engineers, the authority under Section 1108 of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 (NDAA FY09) to appoint qualified candidates possessing an advanced degree to scientific and engineering positions under their purview within personnel demonstration laboratories identified in section 9902(c) (2) of title 5, United States Code.
  3. This authority may be further delegated, in writing, to a level no lower than the eligible Laboratory Director. Section 1108, NDAA FY09 authorizes such appointments to be made without regard to certain provisions of subchapter I of chapter 33 of title 5, United States Code, but limits the number of appointments that may be made using the authority. This authority must be exercised in strict compliance with Department of Defense implementation guidance (see Enclosure 1 for DoD guidance currently in effect), and all applicable laws, rules and, regulations.
  4. The Assistant G-1 for Civilian Personnel Will monitor use of this authority, including its effectiveness in meeting Army hiring needs and will provide quarterly reports for my review. I will suspend or withdraw this delegation in whole or in part, at any time, should conditions warrant.
  5. This authority and delegation expire on December 31, 2013, unless the delegation is earlier revoked or superseded.
  6. To the extent this memorandum impacts bargaining unit employees' conditions of employment; activities are reminded to meet any applicable labor relations obligations in its implementation.
