Notice of Proposed Suspension

MEMORANDUM FOR _________________________ SUBJECT: Notice of Proposed Suspension 1. This is official notification that I am proposing to suspend you for ____( must be 14 calendar days or less) calendar days in accordance with Army Regulation 690-700, Chapter 751, Discipline, as the minimum disciplinary action which I feel is needed to correct your misconduct and promote the efficiency of the service. This action is based on the following reason(s) and specifications(s)

  1. Cite the charge(s), violation, conduct, or offense/reason(s) for the suspension as stated in the Table of Penalties for Various Offenses (Table 1-1) in AR Chapter 751. Note: Misconduct not specifically listed in Table 1-1 may still be the basis of a reprimand.
  2. Provide a detailed factual description of the incident(s) including people involved, dates, times, places, evidence, ect., also include a statement on how the efficiency of the service was adversely affected by the employee’s conduct.
  3. Include a summary of previous offenses if the suspension follows prior offenses and is considered progressive discipline.
In proposing this suspension, I have taken into account not only the charges above, but in determining the appropriate level of discipline, I have considered aggravating factors such as (List applicable Douglas factors). I have also considered mitigating factors, such as (List applicable Douglas factors), but find they do not warrant proposing a lesser penalty.

You have the right to respond to this notice of proposed suspension in orally, in writing, or both within__ (contact the CPAC for the correct number of days) calendar from the date you receive this letter. You may furnish affidavits and other documentary evidence in support of your response(s), if you wish. You must present your response(s) to the deciding official (or his/her designee), who is (Name). He/she is located in Room____, Building _____. His/her telephone number is _______ If you wish to respond orally, you should contact (Name) office to schedule an appointment. He/she will consider extending the time limit for submitting your response if you request the extension of time in writing and explain your reasons for needing more time.

(Optional) If you have a medical condition which contributes to ( specify the misconduct or delinquency) you may submit such information to me for consideration. Any medical information you would like to submit must be provided at your own expense.

You may represent yourself or you may be represented by a person of your choosing. (For employees in a bargaining unit) If you select a representative other than the Union official/steward, you must designate such representative in writing.

You have the right to review the material relied on to support this proposed suspension by contacting (Name), Civilian Personnel Advisory Center, to arrange a mutually convenient time. He/she is also available to answer any questions you may have about your procedural rights in this matter.

You will be allowed (reasonable/sufficient number) hours official time to review the material and prepare an answer to this notice. You must contact your immediate supervisor directly to make arrangements for the use of this official time. Your representative is allowed the same amount of official time if otherwise in a duty status, and must coordinate the use of official time through his/her supervisor.

Full consideration will be given to any reply, affidavits or other evidence that you submit before a final decision is made. Whether or not you reply, a written notice of final decision will be given to you. Should this proposed suspension be carried out, it will not take place earlier than (contact CPAC for guidance) calendar days after your receipt of this letter.
