We are approving your January 13, 2009 request to extend Schedule A authority 213.3106(b)(10), which covers positions in direct support of operations in Iraq and Afghanistan. This authority is extended to October 1, 2012. The authority is amended to read:

213.3106 Department of Defense
"Temporary or time limited positions in direct support of U.S. Government efforts to rebuild and create an independent, free and secure Iraq and Afghanistan, when no other appropriate appointing authority applies. Positions will generally be located in Iraq or Afghanistan, but may be in other locations, including the United States, when directly supporting operations in Iraq or in Afghanistan. No new appointment may be made under this authority after October 1, 2012."

We find that the situations and circumstances justifying your original request continue to exist along with the rebuilding efforts in both Iraq and Afghanistan. In making appointments under this authority, please cite the appointing authority on the Notification of Personnel Action, SF-50, as (Schedule A, 213.3106(b)(10)."

SUBJECT: Schedule A Appointing Authority for Positions in Direct Support of Operations in Afghanistan

The Office of Personnel Management (OPM) approved expansion of the Schedule A appointing authority granted November 24, 2004, to the Department of Defense (DoD) for temporary and time-limited appointments in direct support of operations in Iraq to similar appointments in direct support of operations in Afghanistan. This authority was effective April 1, 2005.

Temporary and time-limited appointments made in direct support of operations in Afghanistan should reference title 5, Code of Federal Regulations (CFR), Part 213.3106(b)(10) on the Notification of Personnel Action, SF-50, and meet the same conditions outlined in November 24, 2004, authority granted by OPM. The OPM approval letter is attached.

I am pleased to grant your request supporting the May 11, 2004, National Security Presidential Directive to use the Government-wide Schedule A hiring authority 5 CFR 213.3102(i)(3) to fill temporary positions directly supporting U.S. efforts to rebuild and create an independent, free, and secure Iraq. Pursuant to discussion and agreement amongst our respective staffs, the Department of Defense will be providing the Office of Personnel Management (OPM) with additional information in support of its request.

Positions generally will be located in Iraq, but may be in other locations, including the United States, when directly supporting operations in Iraq. The security and other special requirements make impracticable the use of competitive examining and existing qualification standards for these positions. This authority is effective on the date of this letter and expires on March 31, 2009. Any Executive agency, as defined in 5 U.S.C. sections 101 through 105, may use this authority to fill these positions when no other appropriate appointing authority applies. In accordance with the Guide to Processing Personnel Actions, when using this authority agencies will cite "Schedule A. 5 CFR 213.3102(i)(3)" as the appointing authority, and "W9R" as the Legal Authority Code.

Please provide the additional information in support of this request, not later than June 15, 2004, to OPM's Associate Director, Division for Human Capital Leadership and Merit Systems Accountability, Marta Brito Perez.
