SUBJECT: Retirement Election Opportunities Under Public Law 107-107, The National Defense Authorization Act for Fiscal Year 2002



The Office of Personnel Management Benefits Administration Letter (BAL) 02-102 at Enclosure 1 describes how P.L. 107-107 changes retirement coverage portability rules for civil service employees with prior nonappropriated fund (NAF) service. The focus of the BAL is on retirement coverage elections for employees moving between Department of Defense (DoD) or Coast Guard NAF positions and civil service positions on or after December 28, 2001.

Section 1131 of P.L. 107-107 eliminates the requirement for an employee to be vested in the losing retirement plan in order to continue coverage in that retirement plan upon a move between the civil service and NAF employment systems. The BAL provides guidance related to employee elections under the new provisions and includes election forms, instructions, and information on verifying eligibility.

DoD guidance on processing retirement elections is at Enclosure 2. The guidance includes instructions and information for NAF employer's use in confirming and documenting employee elections to remain in a civil service retirement plan.
