MEMORANDUM FOR SEE DISTRIBUTION
SUBJECT: Civilian Personnel Operations Centers Notification of
 Mid-term Agreements



This memorandum serves to advise activities of the need to keep servicing Civilian Personnel Operations Centers advised of mid-term bargaining agreements impacting the Civilian Personnel Operations Centers' operations.

Labor unions in the Army are typically recognized at the installation level. When higher headquarters issue a change to personnel policies and practices, installations must notify their unions of the proposed change and afford them an opportunity to request bargaining prior to implementation. If bargaining is requested, implementation is typically delayed until negotiations have been completed.

Where the impact of the proposed change affects only the operations of the installation, the labor relations obligations associated with implementing that change are relatively straightforward. On the other hand, where the change impacts on the operations of the Civilian Personnel Operations Centers, for example, a change to merit promotion procedures, there is a positive obligation placed upon the installation to notify the servicing Civilian Personnel Operations Center when the statutory and contractual labor relations obligations have been met. Without this notification, the Civilian Personnel Operations Center will be unaware when it should begin implementing the change for bargaining unit members. (This process is in addition to coordinating with the Civilian Personnel Operations Center prior to negotiating language, or settling grievances, complaints or appeals that would impose a requirement on the Civilian Personnel Operations Center.)

As an example, when Headquarters, Department of the Army, issued its November 2000, policy establishing TALX, the automated employment verification service, we advised that local implementation of this policy required statutory and contractual labor relations obligations to be met. What the memorandum did not explicitly state, though, was that once those obligations had been met, activities should advise the servicing Civilian Personnel Operations Center director so that the Civilian Personnel Operations Center could affect the policy for the bargaining unit members.

As such, when changes to policies and practices affect the operations of the Civilian Personnel Operations Center, regardless of whether the proposed change is issued locally or by higher headquarters, activities must notify the servicing Civilian Personnel Operations Center director when statutory and contractual labor relations obligations have been met. It is also recommended that, in promoting open communications and efficiencies within the regions, activities should notify servicing Civilian Personnel Operations Centers where delays are occurring in achieving union agreement on changes affecting the Civilian Personnel Operations Centers.
