MEMORANDUM FOR SEE DISTRIBUTION
SUBJECT: Executive Order 13522 -Establishing Labor-Management Forums and Predecisional Involvement

  2. On April 6 and May 18, 2010, the Deputy Secretary and Under Secretary of Defense affirmed their commitment to President Obama's Executive Order 13522, "Creating Labor-Management Forums to Improve Delivery of Government Services" and to the establishment of labor-management forums at appropriate levels. On June 1, 2010, (reference 1 b), I advised you that I fully support this commitment and of the requirement that activities immediately begin discussions with their unions to establish labormanagement forums at the level of exclusive recognition or at other appropriate levels as agreed to by the parties.
  3. In the enclosed memorandum dated August 31, 2010, (reference 1 a), the Under Secretary of Defense requested a status report of the accomplishments of each Component in response to Executive Order 13522. In order to determine the level of success of these efforts, the Department of Defense has established an initial requirement due this month and a quarterly reporting requirement thereafter. I fully endorse and support all efforts in fulfilling the President's Executive Order, and I look forward to hearing of your efforts in th is regard. The requested reports are important in advising the Department as well as this office of your progress. Specific guidance regarding these reports has been issued through civilian personnel channels.
  4. As mandated by the Executive Order, it is also essential that activities engage their unions in pre-decisional discussions regarding all workplace matters to the fullest extent practicable, and further, that activities provide adequate information to union representatives on such matters expeditiously (where not prohibited by law). If you have not done so already, you should conduct discussions with the exclusive representatives in your respective organizations with the goal of achieving a shared understanding 'as to how pre-decisional involvement will be conducted.
  5. An open, cooperative labor management relationship can positively impact the accomplishment of the Army's mission. I therefore expect commanders to be actively involved in ensuring efforts are being made to locally implement the provisions of Executive Order 13522.
